I am hoping to get some advice here. I apologize in advance for the lengthy post here. I am wondering if I am entitled to more rent credit than was given to me. Here is the story:

On September 1st, I found my water heater (in my spare bedroom) had been leaking and notified the office on the 2nd (due to Labor Day the office was closed). On September 4th, the old water heater was drained and removed. On the 5th, the flooring was put in and a new water heater on the 6th. I had no hot water for 2 days. Also on the 5th water damage was found in one of the walls in the master bedroom and at that time found out that there was leaking pipes behind that wall. In fixing the pipes and wall, more damage was found in the flooring down the hallway and in the master bedroom. This resulted in the carpet being torn up and new flooring being replaced from September 10th thru September 12th. This is 3 days of not being able to live in my apartment due to the construction and everything being torn up. At this time with the construction and location my cats were put into a spare unit where I was unable to live at the time because the previous owners were smokers and my asthma would not permit me to stay there very long. Just long enough to check on my cats.

New carpet was approved for the whole apartment on the 12th and was scheduled to be put in on the 19th. It was scheduled on the 19th so that I would be able to get all my stuff moved out of my apartment and into a garage and the spare room (which was already finished and carpeted). With the old carpet being torn up and moldy, my asthma kicked in and I was unable to live there at that time and made other living arrangements, till the new carpet was put in. During the week before the new carpet was put in I had agreed to move all my belongings off of the old carpet, into the spare room (where new carpet was already laid) and a garage that was provided for me to use. This included my whole master bedroom, living room, and dining room. This brings a total of 7 days between the new flooring and new carpet for a total of 12 days of unlivable space.

My manager and her boss ( the apartments are managed by a company) have only agreed to give me rent credit for the 5 days of actual work done in my apartment. not the whole time I was unable to live there. I spent 3 whole weeks dealing with all of this and they say the 7 days they are not responsible for since I choose not to have the carpet put in till the 19th. This was decided by the manager and myself so that I could get everything packed up and moved out of the way and it took me the whole week to do with friends' help. I live by myself.

Any suggestions?

thank you!
