http://www.dol.gov/dol/allcfr/ESA/Title_29/Part_778/29CFR778.105.htm

I don't understand the second question. What exactly is the situation?

Unless you are reallllllllll good at sifting through DOL's website, you probably won't find it. A “workweek” for FLSA purposes is seven consecutive 24-hour days beginning when the employer chooses. Once the employer sets the beginning of a particular employee’s workweek, the workweek automatically ends 168 hours later and a new workweek begins.
