My husband and I both work for a small Michigan Corporation along with about 20 others. We get paid bi-weekly half one week and half the next on Monday.

The company is in big trouble, they have been bouncing payroll checks and other checks constantly. The "cash out" most payroll by having my go to the bank and get petty cash. Over the last few months it has gotten really bad to where people will wait weeks to get paid and as we sit right now we owe half of last week (Monday's) payroll and all of yesterday's. We are paying none today and tomorrow looks bleak as well.

My first question is what recourse do we have? My husband and I are both salary and work 60 + a week with no overtime and I get a flat $35,000 a year and he gets $39,500 a year. I am trying to find another job, but with those hours it is difficult. I have four kids at home and cannot quit because I would need unemployment. He refuses to lay us off, but I think the end of the company is very close.

My second question is would quitting because you don't get paid on time be a reasonable excuse for UIA?

You can file a claim with the DOL. Whether or not you are owed OT depends on exactly what it is you do.

I wouldn't bank on getting UI if you quit as typically some pay is better than none in the eyes of the state. Even if it is late or paid through petty cash.
