View Full Version : Jury Duty - Non-Exempt Employees Texas

I have some hourly/non-exempt employees that are paid only for the hours that they bill our customers; otherwise, they are "on call" during business hours five days per week. In other words, some days they may bill and get paid for 5 hours, other days maybe 8 hours.

Question: Am I required to compensate them for jury duty? If so how should I do this?

Is there any difference between jury duty and witness duty?

Texas is not one of the very few states that requires you to pay non-exempt employee's for jury duty.

Whether they need be paid for being a witness in court depends on whether it is work related or not. If it is work related, you should pay them; it if it personal, you need not.
