Can the state of michigan take money out of an inheritence that will be given from a death fro child support? If the man owes the state but is paying monthly support, do they have a right to take all of it or a portion or none?

It depends on how the inheritence is paid to the NCP.
Does the NCP owe arrears?

How is the inheritence going to be paid, and how large is the sum?

Did the mother collect public assistance and that is why money is owed to the state?

Ok, I had the wrong info. He is getting a life Insurance policy from the death of his biological father. The woman that had his son, was and still is on assistance from the state and he pays her weekly child support. He owes 20,000 in rearages from state assistance and back child support. Will they take the money from him. he is getting 13,000.

Life insurance proceeds are paid outside of the state and probate court. That means that the state cannot intercept the life ins. benefit. HOWEVER, if he is taken to court and found in contempt for non payment, the court MAY consider the insurance when setting a purge amount.
