View Full Version : Restaurant Server Pregnancy Issue Louisiana

My girlfriend is currently 19 weeks pregnant and she is a server in a restaurant.
Recently, the managers have been placing her in sections with smaller and fewer tables (which typically means less in tips), all while making comments that she has been "moving slower."
When she inquired as to why she was being moved into the smaller section, her manager simply told her that she'd either have to "quit whining," or go home.
Is this covered under the statues of pregnancy discrimination?
She has worked at said restaurant for about a year and a half, making her one of the most tenured servers on the staff. And, I don't know if this is relevant, but she works for a local company with extremely high net worth.

How many employees? Has she had any problems with walking or restrictions on her pregnancy? If she is 19 weeks along, do they even know she is pregnant?

There are about thirty employees. No problems or restrictions. And they do know she's pregnant.

Assigning her the smaller sections based on her speed of service is legal. Assigning her those tables only because she is pregnant would not be. This assumes that the tables she is being assigned truly do earn less in tips.
