I am an employer who recently had to fire one of my employees. She stated to me that by law she is entitled to her paycheck on the day I fired her, but my understanding is that I have until my next normal payday. Is this accurate and would you please tell me the statue of the law so I can present this to her. I'm trying to avoid a lawsuit over this and would just like some assistance.

Another question I have is in regards to commission. Is commission something that has to be paid when someone is fired or is it up the the employer? I plan on giving her the due commission, I am just wondering what the law states.

Relative to commissions, as long as they can be calculated at the time you create the final paycheck, I'd pay them with that check.
