My husband has called in sick 2 times in year. the employer is demanding a doctor's note for one day (he had a gastric issue- if ya' know what I mean).
Is this legal? Does he really have to go to the doctor every time he has a poopin problem? Again, this is his second call in in a year. The other time was during the winter for one day. They were both not a Friday or a Monday.
Can he refused to give them one?
Oh..this is unpaid sick time.

Outside of FMLA, and from what you say FMLA does not apply, an employer in any state can request a doctor's note as often as they choose to. So yes, they can request a note for every absence, and if he refuses to supply one, he can be fired.
