First off I am a non-exempt employee in Colorado. I put in my two week notice last week (Monday) and took a legitimate sick day on Friday. Today I was told that they are going to dock my pay for the 8 hours missed, I had 10 hours of sick time accrued. I was also told that because I put in my notice that my sick time was no longer valid. Is this valid?

It's not only legal, it's common to not allow employees to utilize paid time off during their notice period.

Thank you for your quick response. I am not sure on the legality behind the attempted dock of pay but I did check the corporate policy on applying accrued sick time after a notice and it states that the hours will be honored with a Dr. note. I provided a Dr. note on my return this AM and have since resolved the issue. The scary part is I had to take this to the highest levels of HR to get it resolved, a tremendous waste of time but i did get my pay. :)

You are fortunate that you were able to get HR to honor the promise in the company policy. Not all folks are so lucky.
