I worked for a restuarant in Boulder, Colorado for about 2 months.

During that time I discovered that the owner was putting the money for the restaurants in a seperate account than the paychecks were issued from, so all of the paychecks he issued bounced, incurring charges on our accounts.

He recently sold the restuarant, and owes me about $250 from unpaid wages and bounced checks, and my coworkers money as well. He is going to open up a new restaurant on Pearl Street. He has a reputation of running restaurants into the ground.

I contacted him about getting my money, but when I called him back to meet up he had blocked my phone number so I have no way of getting in touch with him. I know that he systematically does not pay his workers, and he was forced by the court to pay for advertisements he took out, although he dodged paying these for quite a while as well.

I would like to force him to pay me and my coworker, or at least prevent him from opening up another restaurant so others do not have to go through this issue. I suspect he has not paid the social security or other federal/state taxes he took out of our pay check.

Should I take him to small claims court? Should I report him to federal and state tax agencies? Please give me some advice!

You can't prevent him from opening another business.

You may suspect he hasn't remitted the taxes withheld from your pay, but you don't know it.

You CAN file a claim for unpaid wages with the state Dept. of Labor. And you can sue in small claims court for fees you may have incurred for bounced checks; I have no idea whether you would prevail or not.

if he has not remitted the taxes, will this reflect on me later?
