View Full Version : Delivery Drivers paid waiter wages Texas

I work as a delivery driver for a local pizza company and was just informed that the company has decided to pay us a lower amount as a driver.

Let me explain.
Drivers will be paid $5.50 an hour when dispatched, and $6.55 when not on a run.
Calculating a 40 hour work week we are on the road for 30 hours out of the week.
I was told we would be reimbursed if our wage did not equal 40 hour at $6.55.

My question is what kind of reimbursement can I expect if I make $7.55?
Do they have to make up to my pay or just to $6.55?

To let it be known my tips go right back in my gas tank.

Any help would be appreciated because if this is legal I am losing up to $100.00 dollars a pay check.

As a directly-tipped employee, the employer must only make up the difference to minimum wage if your tips do not bring you to an average of minimum wage for all hours for which you do not receive the higher rate (because you aren't on a run). The law doesn't require the employer make up the difference to your non-delivery hourly rate.
