Hi. My employer is based out of Massachusetts, however, my workplace is in RI. My employer has a "use it or lose it" policy when it comes to vacation time. Is this legal in RI?

When terminating employment, in most situations employers must pay employees for accrued but unused vacation time. That provision applies only when an employee has completed at least one year of service. There's no comparable statute for sick time.

Re "use it or lose it" policies: The issue isn't directly addressed by state law, but given the requirement that employees who have completed one year of service can't lose accrued vacation time and the lack of a statute on sick time, "use it or lose it" would likely be permissible for sick leave.

How long have you worked there? add: I just noted from your other thread you started there *almost* one year ago. Where is this policy your employer has written?

Thank you! This policy is located in the Employee Handbook. My first year will be complete on July 23rd 2008. :D
