View Full Version : CAN I LOSE HOURS DUE TO OTHERS MISTAKES Virginia

I work for (A GROCERY STORE) and my Customer Service manager (who also makes the schedule for the cashiers and baggers) has decided to give all minors 4 hour shifts because the new people that she hired got "minor violations" because she didn't tell them to take their breaks and they went over 4.5 hours without a break. (which is either against company policy or Virginia State Law) I have been working at this store for a year and she just came in there 3 months ago and she just chaned the way that our store operates and she has caused at least 10 people to quit so far. I was just wondering if she can technically give minors 4 hour shifts because of her lazyness. I am used to working 28 hours a week and now she only wants to give me 12 hours per week and I don't think that she can give me less hours than i was getting before because of my age! Who is right me or her?

Agreed. Also, putting the employer name on a public website is arguably not a very good idea.

She can give any employee she wants, any hours she wants, unless the employee has a bona fide contract or CBA that GUARANTEES them a particular number of hours per week.

If the manager doesn't want to babysit employees to make sure they take their breaks, it is entirely legal to schedule them so that this is not an issue. If employees would rather quit than accept the new manager's policies, that is their right but it doesn't make anything the manager is doing illegal.

So are you saying that its NOT discrimination based on age because she is giving ALL minors not just me 4 hour shifts because she was to lazy to tell the new people she hired when to take their breaks because they were under the impression that they didnt have to take a break in a 8 hour shift because she never told them that and now all the rest of us suffer because of her ignorance! Also, I tried to talk with her yestarday and tell her I was trying to buy a car in the next couple of weeks and her giving me only 12 hours this week was like a slap in the face. Her response was get used to it all minors are getting those kinds of shifts from now on!

I'm sorry you are upset but the law does not entitle you to a specific number of hours per week.

If you need more shifts and this company wont do it, then find another job that will give you the hours you want.

It isn't illegal discrimination. Your desire to buy a car is not your employer's problem. They do not have to give you the hours you want to support your personal spending habits. Maybe you can politely ask to work an extra day a week. However, the attitude you exhibit toward your manager tells me you have a lot to learn about the working world. I certainly would not take the approach you have so far if you expect to be taken seriously.

This is NOT illegal. You do not have a guaranteed right under the law to work the number of hours you want to work. If she wants to schedule minors for 4 hour shifts, she may LEGALLY schedule minors for 4 hour shifts.

thanks thats what i was trying to ask! thanks for answering my question! i do plan to speak with my district manager to see if this is against company policy or not!

I would be totally amazed if your company policy even adressed this. Its not something that would even be covered normally.

Be aware that taking this up the corporate ladder (over your boss's head) may cause you some friction with your boss.
