My ex is taking me back to dr court to stop his obligations to pay support. He says he hasnt been working since 12/07 because he was diagnosed with sleep apnea. we went to court in march to reduce it and I got my ex to agree to take it from 400 a month to 250 a month. the court person had said he had the right to end it there and then because of the medical papers my ex provided. he claimed his employer wasnt co operating with him and he was going to sue them over it.

(I still am unemployed though actively job searching and have a promising interview on monday.)

I agreed to the reduction on a temporary basis because he promised to help when necessary if i called. well he didnt stick to that at all. so now I want it put back up to the full amount, not cancelled. he claims he's poor yet friends, my child have mentioned their constant shopping since our court appearance in march. he got a new paint job for his car, he and his wife got new tattos together, they bought a pool for their house, are doing minor things to the house. eating out with my daughter at least once a week.

what can I do to prove he is just being a lazy sob who doesn't want to see me get his money (i only spend it on her) despite the fact that it will be detrimental to our child?

Treatable. One machine and you get a good nights sleep.

Don't get me started on what a sorry (!!!) piece of work he is for not paying child support. Take him to court, and stick it to him.

Most doctors have hand outs that show how you can have a normal life with a CPAP machine. I have had one for years.

I agree with Gotsmart, you should fight this. Gather all you can documenting that sleep apnea is treatable and that it should not prevent him from holding a job.
Mention the expenses that he and wife are spending, only as a last resort, because he can always claim that it is all his wife's money. But you should mention that he has claimed that he's going to be suing his former emplyer so you can claim that if he prevails, he should have some money coming in in his name.
