View Full Version : Need help with state minnimum wage West Virginia

I have been employed by a major restaurant since aug. of 07, it is a fairly known and popular place of business. Since i started I've made (along with others) 6.35/hr according to federal min. wage is fine, but i come to find out today the effective july of 07 WV state min. wage is 6.55/hr, I and just about the entire crew has been makeing below state min. wage for a year almost, also, effective today state min. wage is 7.25/hr i still make less an hr than that. I am not a tipped employee, is this wrong? Should they as a public business with about 15 to 20 employees obied by state min. wage or federal, and if they have to comply with state, should i be owed back pay for the year i worked under min. wage?

Whichever minimum wage is higher is the one that applies. You can file a claim for the difference with the state Dept. of Labor.

You should be making the state min. wage which is higher than the federal. File a wage claim as the other responder suggested with your state's DOL.
