TEXAS - At the moment, the child is in joint custody with her two parents, the father being the primary guardian. However, there has been a change in the situation due to possible molestation of another child who was at the time aged thirteen, and then again eighteen. The younger daughter, who is seventeen, does not feel safe with the father any longer and already is having a 'strained' relationship - so she wants to live with her mother. We are aware that we need to go to court to get custody changed, but we don't believe it is a safe place for her to be until we can take care of that. So, I must ask, what steps can we take at this point? We were advised to get an emergency custody order by another legal adviser, but this person apparently doesn't know the state specific things we must do. If this is possible to do, what exactly do we need? We tried to take care of it at the district court but they just gave us a pretty confusing runaround. And well, is there anything else we can do?

You are the 17 year old, correct?

"WE" can do nothing.
However, your mother can file for a modification of the custody order, which is what you were told in April.

Please expain the molestation situation, who molested who, and was the molester arrested AND convicted?

The only way that an emergency custody modification can be filed is if your mother can PROVE to the court that you are in immediate danger, can she prove that?
