View Full Version : 12 hour shift, starting final day pay period California

Overtime for Calif employee? If the shift starts on the 15th of the month at 4 PM and the shift does not end until 4 AM on the 16th - this is 12 hours worked. The time from 12:01 am to 4 AM is on a different pay period - is the last four hours considered regular time on the next pay period? Or is it overtime earned for the pay period starting on the first and ending on the 15th?

I am an hourly paid employee dealing with this issue once again .... anyone else feel frustrated?

Under federal and CA law, overtime is calculated based on the "workweek", which is a fixed 168 hour period of time unrelated to shifts and schedules. While it is possible for an employer to have more then one workweek, this would be very unusual. My last 4 employers were based in CA, and all four of them used a workweek that ended Sunday midnight, even though none of the shifts actually ended at midnight.
