i'm married and have a 6 yr. old daughter from a past relationship. I haven't been with her fater in 5 yrs. he has not paid a dime of child support and the courts won't even set an order because the type of SSI he's on. Now in the past 5 yrs. he has done nothing for my daughter but has 2 other kids he takes care of. He said he wont do anything for my daughter because we're not together. He hasnt seen my daughter since christmas! About a yr. ago she started calling my husband dad and he wants 2 adopt her but her "father" will not sign his rights over! any advice on this will be greatly appreciated! i just want to be done with him! it's been 5 long years and im tired of him not acknowledging her.

Without Dad willing to sign TPR is pretty much a dead issue. You can hire an Attorney and spend a great deal of money and still not get results you want

Get a consult with a local attorney to see what your reasonable chances are for an involuntary TPR. It is extremely difficult to do, especially when the father is a part of a child's life, even if only occaisonally.

If he last saw his daughter at Christmas, that was 5 months ago, so you won't be able to use abandonment. Nor can you claim non support because he is disabled and there is no court order for CS. But, it won't hurt to get a consult anyway, just in case.
