View Full Version : Changes to health ins coverage when electing COBRA

My husband's employer only has 1 type of option for health insurance and then vision and dental. COBRA cost is 2K per month. We feel we must take the COBRA but want to drop vision and dental in order to reduce the cost. her employer says that it cannot be done. He was terminated. I thought that termination of employment was a qualifying event to make changes, such as change in health insurance plan (can't do it with them since there is only one), choose dental, choose vision. A previous employer that I had made me elect the coverage and plan that I wanted; and they were an insurance company.
Does any one have some thing I can show, under ERISA or Virginia law, that would force the employer to allow an employee to elect the coverage desired?

No, I can't, because there isn't anything. If the coverages are bundled for active employees, they are bundled for COBRA too.

If your previous employer had unbundled coverage, that's fine. If the current one doesn't, then your HR person is right.

Tell me if I am missing something technical in here. I assumed them to be unbundled, since he could choose medical, dental and vision, separately.
