View Full Version : Working Consecutive Hours/ When does a new day begin? CALIFORNIA California

My work week is calculated from Monday-Sunday. I work 40 hours during the week, during normal hours (example: 9:00a - 5:00p). One weekend per month, I work from Saturday in the early evening to Sunday in the mid morning. This work usually takes 14-15 hours. Normally, my company pays double-time after 12 hours, but I'm told that the day starts over at midnight, so I'm paid as if I worked say- 7 hours one day and 7 hours the next, event hough it was 14 consecutive. Is this legal?

It is if the day really does start at midnight, which is common.

workday
Any consecutive 24-hour period beginning at the same time each calendar day. The workday may begin at any time of day. The beginning of an employee's workday need not coincide with the beginning of that employee's shift, and an employer may establish different workdays for different employees. Once a workday is established, it may not be changed unless the change is intended to be permanent and is not designed to evade the employer's overtime obligation.

Yeah, but at least I will reap the benefits of working a 14 hour overnighter on the weekend.

I did get paid overtime for this though because it was on top of my regular 40 for the week. I just didn't get double-time for a couple of the hours.
