View Full Version : What constitutes harassment? Massachusetts

I have a question for you guys and I will explain my situation.

Yes I am the boss's kid. I also realize I spelled my username wrong. Whatever. Neither here nor there. I bust my butt. It's not uncommon for me to log 60 - 70 hours a week in the business. I understand as the son of the boss I do have a target on my back.

What I really want to know is what recourse if any I have against a co-worker and/or employer for harassment. On multiple occasions a co-worker has said to me "you do too much blow," I have had some other run ins with this guy and my boss/father has failed to take action. My dad thinks I'm being melodramatic. But I'm dead serious. What it gets down to is that on four occasions this co-worker of mine has flown off the handle making outlandish accusations. He has ruffled feathers with four of my other co-workers. Nothing has been done.

I am tired of this behavior and my boss's inaction to deal with him.

I was wondering if there are any steps I can take, legal or otherwise, to change the work environment.

I understand that as the boss's kid you are going to have to endure some ball busting, but I am not the only one who has gone through this and it really makes for a hostile work environment.

If I have to sue my father to stop this I will.

Being the boss's kid is not a protected class.

If you were being treated badly for illegal reasons (because of your race, gender, disability, etc) then it's harassment. Ditto for a "hostile work environment."

Your boss is under no legal obligation to get rid of someone who is being a jerk, even if you are the "fruit of his loins."

If you want a future in the family business, it's probably best to take the high road and show your dad and co-workers that you are the bigger person, an adult, and a professional.

Suing your dad would limit you in your career, and probably cause an irreparable family rift.

I never went into this expecting protection. But I also never went into this expecting to be accused of "doing to much blow" (when I've never touched the stuff).

I'm not saying that I'm going to sue my father just because. It may cause a rift, but if going to court is the only way to resolve this then I have no problem doing so. If I actually had to go through with it I would seek a total of $1 in damages. I just think that there has so to be some way of stopping the erratic behavior of this guy. There's no reason why anyone should have to suffer attacks on their character when they are doing their job above & beyond.

Why does it matter if some idiot says you do drugs? You know you don't. the other people know you don't. He probably enjoys getting a rise out of you.

For your own, good, be a grown-up and ignore it. You obviously have a decent work ethic, working so many hours. Stay focused on your goals and don't let him get to you.

I understand it is unfair that you catch this crap.

Unfair does not equate to illegal.

Making fun of you for being the boss' son is not illegal.

Have you thought about telling dad that one of you goes.... and then leave if it doesn't happen.

If your first thought is "I couldn't find a job that pays this well anywhere else", then you have your answer on what to do next.

Believe me, I know I could make more money elsewhere. I'm not sharing my wage. I recently upgraded all of our computers from Digital VT dumb terminals to Windows machines running emulation software. I completed the upgrade for about $2700. The bang for the buck is pretty incredible.

Bottom line: there's harassment, and there's illegal harassment. What you describe is NOT illegal harassment, and it does not provide you with legal recourse.

Well it doesn't change the fact that my father is in love with this guy regardless of his incompetence, alcohol abuse, theft, and inability to not look at porn all day. So even if it were illegal harassment I doubt I'd see the change needed.

I guess I should refer my Hispanic co-worker to legal aide as this jerk likes to use pejoratives when referring to this guy.
