View Full Version : Two H1B Visa New Jersey

Hi ,
My name is Rahul Sharma; I am from Delhi India
I have a H1B visa and it is Valid up to 2009 which is sponsored by a "xyz" Delhi based consultant in last year (2007). But I don't want to go with "xyz" consultant because of there bad reputation in the US market (few of my friends who had worked with "xyz" consultant, have a very bad experience in respective of Salary, job, there irresponsible behavior & so on …..)
Mean time (in January 2008) I had contacted with another Delhi based "ABC" consultant and apply a fresh H1B in 2008 window, and in lottery system my application is got selected, petition is yet to come.
Now I have a query like this
1) When I will visit for visa stamping to US embassy (India) most probably in the month of October 2008, what will be the questions/reaction of embassy counselor on above situation?
2) What should, I reply them on probable questions (Like if u have already valid H1B visa then why u had applied for new one?)
3) Will they stamp on new H1B visa?
4) Will they cancel my existing "xyz" consultant H1B visa?
5) Can a person carry more than one H1B visa?

Did your new employer simply transfer the H1B to them from the old company? You can only work for the company who sponsored the H1B. If you are not currently in the US working for an employer physically in the US, you don't have need for a H1B.

As far as I know, one is allowed to have more than just 1 H1B stamped in the pass, so go ahead - you can proceed to the embassy. Recently, a friend of mine who had also 2 I-797, but only 1 H1 stamped, left to US to work for an employer he doesn't have the visa stamped for - but he was approved to. Looks like it is legal as well...

That is not correct. The I-797 is issued for the H1B has been approved. It is for a specific employer and may not be used for any other employer other than the one designated.

Very true. But the visa itself, it is only used for the port of entry (as far as I know). You can work and pay taxes for an employer you are approved to work for, right ? If you have 2 I-797... what's the best way to handle them ? You are basically approved to work for 2 different employers.

Only one can be valid at a time. If a person worked for one employer and then had the H1B transferred they would have two, but only one is valid.
