View Full Version : Deadbeat Dad (Joseph C Blessett) In League City Texas

I was divorced in Galveston County, Texas. Ex-husband was court ordered to pay child support in 1999. Here it is 2008 and child support is in arrears of $64,000 and he makes payments of $10/mth. I have cooperated with the Texas Attorney General and Child Support Enforcement here in Denver, where I currently live and all I ever get is there is nothing they can do until Joseph is served. Keep in mind this deadbeat dad makes 6 figures a year and he pays $10/mth just to keep the courts satisfied. One statement from one of TAG office was, "well at least he acknowledges that he has to make payments." What is this representative thinking, $10/mth what a joke. Joseph's attorney informed him how to avoid being served, so he has put everything in his wifes name, even the house that he and I bought while we were married.

There have been several court dates set, but because Texas Attorney General failed to get him served the court dates have been rescheduled for the last seven years. I even went as hiring a PI to locate him and he was found in two days and the TAG was notified but their response was, we have to use our resources, which they have failed for the last seven years.

Please explain to me how our judical works when TAG has failed for seven years?

Most CP's don't know this, but a CP has the right to file a contempt motion, or a show cause motion (whichever your state normally uses) on thier own. The state CSE agency CANNOT stop you.

First, you find out which motion your court uses, then you get the form, fill it out, attach a copy of the court order and a certified copy of payment history to the motion. Make 3 sets of copies, file the original with the court, serve your ex with a copy according to the service rules for your state, and, the most important part- give the CSE agency a copy. When a hearing is set, make sure the CSE agency is provided a copy of the hearing notice.

Yes, the caseworker most likely will be mad, and might even tell you that you cannot do this, or they will drop your case- legally, they cannot do either.

The best way to do this is to get a short consult with an attorney to find out exactly what the service rules are so that there won't be a problem with service. It doesn't matter if your ex put everything in wife's name. that does NOT prevent him from being served, nor does it prevent the court from enforcing the court order.

I'm just reiterating Xena's statement. I live in TX. This is 100% correct and TX courts REALLY don't like parents skipping out on CS.

The OAG is overwhelmed wtih collections. That's why you are having a problem.

Hi!

I have dealt with the OAG to collect child support so I feel your pain. When I knew they were not doing their job, I wrote an email to Mr. Gregg Abbott and my US senator - expressing my dissapointment about services I got from the OAG. You know what happened next? I got a respond from the OAG staff pretty quick and resolved the issue right away. So tell them what you were told by the OAG reps, how frustrated you are, and ask for their opinion on the matter.

I think writing an email to your US senator is the best way to put fire under their butt. Because I know, for the fact, that the OAG freaks out when the senator's office contact them requesting the info on your case.

To find your senator, google "who is my representitive."
