View Full Version : Statute of Limitations in TN Tennessee

I just ran across this forum and after googling the heck out of this question, I thought maybe someone could help me with this. I am 38 years old and I am fairly well off so this question may seem strange but it comes down to what is rightfully owed to me.

I would have never pushed this but unfortunately my father never paid a dime of child support that he was supposed to during the years I was younger. While I was fine with that I have just went through a horrible probate battle with my family and basically things that were left to me and other were basically cheated away from us through some slimy lawyer tactics from my father's friend and politicians. So basically on principle is there anyway to file against him for the never paid child support? He is financially well of so I guess it is just on principle now and not on "I need the money".

As I said strange question but I was curious. Is there a precedent for this?

I don't know if there is a time limit on filing for unpaid child support, but you should be aware that any unpaid support is not owed to you, but to your mother (or whoever was the custodial guardian for the time your father should have been paying support).

Not such a strange question here...it comes up quite often from disgruntled kids of non-custodial parents who didn't pay.

No, there isn't in TN. There is only a couple of states that have laws allowing adult children to collect CS arrears, TN is not one of them.

However, there is no statute of limitations in TN for collection of CS arrearages by the custodial parent. So, IF there was a court order, your mother can go to court to enforce payment of the arrears, but you cannot.
