View Full Version : Laid off and can not get answers!!! Colorado

I have a few questions... I was laid off from what the claimed to be "position elimination" per corporate office restructuring. I was laid off a very hard day of work on Thursday the 22nd of April and of course they waited until I was completley done, 4 hours later than normal. Sorry, not the point, just a little hostility. I worked and ran that place for over 5 years. I was a salary position.

When I was pulled into the office, I asked quite a few questions and was given little to no answers.
First was; I am going to get a severance package?
He told me that he would have to check because if he does it for one, he will have to do it for all. Still waiting to hear.

Second; When would I be receiving last paycheck?
He said - He would have to check. Still waiting.

Third; Need to get insurance info to contact them. Left it all there.
He still has not gotten back to me.

Fourth; How much vacation am I going to get paid for?
He said - He would have to check. Still waiting.

So all wrapped up, is he not supposed to have all this information before he even lets me go? It makes it really hard to wrap things up on my end and get moving on when I can not get an answer and when I call all I get is his voicemail. I understand he owns 2 companies and is very busy but that really is no concern of me. Is he supposed to have my pay to me within a certain time period? Is he supposed to have papers for me to sign or give me at time of layoff? Is he not supposed to let me know all these very important things within a time period?

As for the insurance, your employer has 44 days from the date your coverage terminates to get you the COBRA information.

Severeance is not required so it is up to your employer and no, they do not have to tell you in any specifc amount of time

Thank you for your quick response.

See, that is what I am trying to figure out is when they are or have terminated my insurance and I can not get an email or call back with just the phone number to the insurance company. I called the number on the back of my card but they don't know anything because my company went through another company to get the insurance. You know, the middle guy.

I just can not get any type of any response for anything. I do not expect severance but I would like to know! And when I am going to get paid my final check. And how much vacation I am going to get paid. Do they not have to get payment to us within a certain time frame?

You apparently didn't read the fact sheet ElleMD provided, because it states when you must receive your final paycheck. Go back and read it.

Did you read the link? It addresses several of your questions. The rest are up to company policy with the exception of the insurance. The policy may cover you until the end of the month or it may terminate with your last day. If you have the summary plan document it should be stated in there. If there is an HR person, ask them. Your manager may not be the best source.
