I know this will be long but I will try to explain all.
My ex ( I will call him Z) lives with a female has a child, who is not his. He is supporting this child. One of my children who is also not his, who is 19, is also living with him and he is supporting (This child is getting married in July). My ex Z has 2 children with a ex-wife A and one child by me ex-wife B. He hasnt paid child support to ex-wife A since Jan and none to me since Dec. Exwife A has child support thru Dept of Human res, and it was payroll deducted out of his check, Mine was paid to me from him directly, but actually was suppose to go thru the court.
During one month I can prove that ex Z gave his girlfriend over $500.00 and paid for her sons schooling. I have copys of canceled checks from a joint account that he was suppose to have closed when we divorced a yr ago and he didnt close it. Will this help me? He isnt paying any child support or making any effort to pay anything but is supporting another woman and her child? I have other canceled checks of rediculous stupid stuff that money was spent on that he claims he didnt have any money to pay child support. (None of which any of those checks were paid on any bills, such as electric, water, housing, food, ect.) He also had another checking account in which I assumed he was paying those bills from. Only an idiot would have used a joint account to buy from a book store, eat out, write the girlfriend checks, another kids schooling, buy maps from e-911 county then claim he was broke. I would love to have him locked up and his bail set for the amount he owes for his other 2 kids and my kid. I dont know if it would work like that?? Can I do that? How do I do it? I am sure Ex A would be in agreement with it, she does however live in another state. Total he owes for his other kids is about current and arrears 2000.00 and he owes me current and arrears 1600.00 (mine includes medical bills he is way behind of paying)
Ex A will recieve any Tax money first because the 2 children are first priority, and the faster she gets her child support the faster I will get mine, So it does benifit me to help her. Her 2 children need it more because she is a single parent and I have a wonderful spouse that takes excellent care of my daughter. Any info would be helpful. Thanks all for letting me vent too, although I could really vent alot more then I have. When ex Z was with me I made sure his support was paid to Ex A. This issue just makes me so angry with these people going on with their life like they had no past, including not only money but not even spending time with their kids when they have a chance. It is the children that suffer !!

Both you and 1st ex wife can, and should file for contempt. Neither of you have to prove anything, all you need is the court order and payment record from the court. The legal burden will be your ex's. He will have to try to prove that he has good reasons for not paying (such as documented illness, injury, lay off, or some other form of INVOLUNTARY loss of income).
