To make a long story short. I ended up impregnating a girl I was dating while her and her husband were seperated. Well now they are back together and she wants me to have nothing to do with the baby. But still wants me to pay child support. I had a DNA test done to prove that the baby was mine but she says his name on the birth certificate. Can she make me pay child support even if I give up rights to the child?

The likihood of a successful TPR are slim but if successful you would only owe any arrears you have

Was the paternity test done via court order or was it a private test that you had done just to prove to yourself that this is your child? It makes a huge difference.

Is there an actual child support order?

As the child was concieved (and obviously born) during the marriage, her husband is the legal father of the child.

In order for YOU to be the legal father, you will have to file suit to challenge/establish legal paternity, custody/visitation, and child support.

Do not pay a DIME until there is a CS order in place.

If legal paternity has not been established for you, you have no rights to terminate.

While child support and custody are decided separately, being deemed the father of the child for one usually carries weight as for paternity on the other.

In other words, I have never heard of someone being deemed the father for child support but not for visitation.

It wasnt a court ordered test. I told her I wanted one and paid for it myself. There isnt currently anything legal saying I have to pay her support. I had been when she was actually letting me see the baby though.

Without a court ordered or approved test you are "not" the child's Father! This means you owe no support and can be refused to see child. You pay nothing! any monie syou pay to Mother will be considered a "gift" meaning if an order is placed later you could owe for back support. Get a court ordered paternity test. Once you are established as Father then you can pursue the other issues of support/visitation/custody
