I have been working for my current job since early Jan. this year and have done a great job. It is a sales position and many times i outsell anyone working with me.
I have been flexible on hours and very generous when being called on my days off. The first sign of my not being able to do one of the days i get told the manager is mad at me because he was forced to work that day.
Mind you i did ask for extra hours months ago and have been doing everything i can to get them but my wife needed some medical treatment this day.
Now a few days later (the second time since i started) our paychecks did not arrive. We are told it will be the next day before we get them. Everyone is unhappy and i am worried as i had bills automatically coming out of my bank that were going to cause me an overdraft without my check.
Now i asked our area manager whom i've spoken with plenty and done many favors for if there was anyway i could get some money from our store and pay it back tomorrow with my check. After all me not getting paid was in no way my fault.
He told me no and i say ok. I get home from my shift and within 10 minutes get a phone call with them telling me i am fired for a bad attitude and because i asked that question.
After a long discussion with the man i am told that i can have my job back but i have to come in tomorrow and i will just be written up for the incident... which i will have to sign. I can add what i want he tells me.
My question is should i sign it or just cut my losses? I really need the job but with the knowledge that this will be completely uncomfortable to work now along with the fact that signing this paper is saying i did something wrong...
I do not see where i said or did anything unreasonable. I never raised my voice and asked a simple question. I was a tad frustrated but so was everyone else.
Also as per my return to work the area manager told me part of the agreement is that he will not hear another complaint from me about the company.
Here's the other stuff... this company is a kiosk in a mall. They put us on 4-6 hour shifts sometime more. We get no breaks and have to stand on "marble" like floors with no padding and no seats. The managers will come and do little to no work and play on the internet while the employees work.
All the local bosses i have met are good friends with the area manager and my specific store manager got hired in after me because he was "more qualified" yet i had to train him on several things with the store and the manager i had before him who did a great job got bumped down to regular employee and his pay was cut.
They knew he wasn't happy with it and slowly worked his hours down to force him to quit and find work elsewhere. They quoted me something about not having been working here for "90 days" so they could just fire me on the spot.
I have heard they have either forced out or fired many employees before those "90 days" is there some protection for this kind of abuse?
I am not sure if they are breaking any labor laws with this or not and have to sign this sheet tomorrow so i am here in search of some advice. Well this is everything i can think of for now. I appreciate your responses and hope i can get some answers.
