I am 21 wks. pregnant and started a new job last week as a front desk rep. in a hotel. I am in training now but I start the front desk on Monday. I don't know how to go about telling my new boss as I am starting to show. Also I don't understand the laws, I know I do not fall under Family Medical Leave because I have not been there for at least a year, but can they fire me for maternity leave? I have heard some people call it voluntary termination. Can someone please explain to me what my rights are for discrimination and maternity leave? Also can they put the fact that I did not tell them about the pregnancy before I was hired against me? Thank you.
Florida has no statutory maternity leave and as you have already indicated, you do not qualify for FMLA. Therefore, it is up to your employer how much maternity leave to grant you. It can be as much or as little as the employer chooses, as long as it is not less than a similarly situated employee who has a non-maternity medical condition (examples, pneumonia, a broken leg, back surgery) would receive.
A voluntary termination does not mean you were terminated for medical reasons. A voluntary termination is when you quit.
You cannot be fired BECAUSE you are pregnant. You can be fired because you exceed the amount of leave they are willing to give you, with the above mentioned caveat.
No, they cannot hold it against you that you did not tell them about the pregnancy beforehand, if by hold it against you, you mean terminate or discipline you. They are not required to be happy about it but they cannot take any adverse action against you because of it.
