View Full Version : Repayment Sick Time- Won't Cash Out

:confused: Hello,

My husband works for a company that recently downsized and he was almost terminated. Instead they offered him a different job within the company at a different branch. In the process of him starting the new position, the company's payroll department included sick/vacation time that he accumlated in with his regular paycheck (Something they were going to do if he left the company). My husband got a bonus in with this same payroll check. Because of all this, we did not realize that he was paid the sick time - with the taxes that were taken out we didn't notice any extra money. Now 2 days before he is due his next paycheck the company is requiring him to pay back the sick/vacation time that he was paid because it is not their policy to "pay out" for the sick and vacation time. They said he can still keep the time he did not use. We do not think this is fair- that his pay this week should be cut in half because of a mistake that they made. We are willing to give up the time, but because we were not expecting his pay to be less this week and we are in a difficult position - we have bills to pay! Is what they are doing illegal, do we have any rights?

It's probably legal, the fact that you didn't see much "extra money" not withstanding. Did the paystub not reflect Vacation and Sick as being paid?
