Hi there,

I am a women's fashion manager in Michigan. Recently, I was notified that 14hours of lunch time (lunch=30mins) was taken out of my pay check (for back lunches, Jan-Mar). I was told about 3 weeks later, after the fact. Then I was told they were taking 5 more hours out of my last pay check for lunches I didn't clock out for. My boss says I have to take a 30min lunch by law. These 30mins add up . . . I usually take 15mins, don't punch out, because that's all I need.
How many hours worked must you take a lunch? Is there a MI law about punching out for 30mins? Can I wave my right to punch out, somehow?

I've worked here for over 2yrs, do I get time and a half for working of Hollidays, Easter?

Michigan law does not require meal breaks or rest breaks for adult employees. However, if the employer requires one, you take one. If you worked through the meal break, assuming you are a nonexempt employee, you must be paid for that time. I would speak to the manager first regarding time that you may have not taken a meal break. A 15-minute break would be compensable by law under the FLSA.

If they refuse to pay you, you can file a claim with the state Dept. of Labor. However, I don't think you can go back that far; you'll have to check with them to see.

There are no laws in your state mandating overtime pay for working holidays. However, if you actually worked over 40 hours in that workweek (and again assuming nonexempt) you must be paid overtime for the excess hours over 40.
