View Full Version : Fired 1 month before maternity leave California

Hi,

I've been with my large california employer full-time for 1.5 years. I got fired 1 month before maternity leave, due to non-pregnancy issues. My company offers short-term disability which i was planning on using as part of my leave after the initial 12-weeks. My question is since I cannot find another job given I only have 1 month until delivery, do i still qualify for maternity leave and/or short-term disability?

If you aren't working, there isn't a job from which to take leave. By default, you will be off work. I have no idea what the terms of the plan you have are and if it is still in effect or will be still in effect when you deleiver. you will have to read the policy.

If you don't qualify for your company's STD plan, you can file with CA SDI. 800.480.3287

You may be eligible for Ca. SDI benefits if you meet all of the following criteria:

You are unemployed and disabled. (includes pregnancy)
You were working when you became disabled.
You are unable to do your usual work because of an illness or injury.
You worked in covered employment.
You have a physician's certificate supporting your claim.
