I purchased my land 3 years ago. The former owner told me that on the deed there was a right away for my driveway. On the deed it says "Forever right away" I come to find out two weeks ago that the right away is for another neighbor.... I found out by the guys surveying the right away. My question is, I have been maintaining the driveway and I'm in the process of repairing the little bridge that crosses a small creek. I have no idea who this person is and no one has contacted me. If I move my driveway 60 ft. from where it is now, only on my property, can I tear up the old driveway which is no use to me.... He can construct his own driveway.
The driveway has been only for my house for the last 25-30 years.
Who owns the land that the right away is on...me??
