Hi I have 2 questions??
1-I was wondering what the rules are for a Mgt/Salaried employee. I work an 8hr day 0900-5pm Mon-Friday. And I have always take my lunch during that 8hr period and paid for it. Now I am being told that I need to work 9hrs a day to make up for that lunch. ie work 0900-6pm now. I am not an hourly employee and all along I have been paid for this lunch during my 8hr day and now they are trying to change it.
2-During an 8hr day how many minutes are allotted for breaks in an 8hr day??

No law in any state requires your employer to provide you with a PAID lunch break, if that is what you are asking.

During the 8hr workday. How much time in that 8hrs is state law for breaks. I was told that there should be 2-10 minute breaks included in this 8hr time period is that a fact or myth??

Colorado law requires employers to provide a 30 minute unpaid, uninterrupted meal period after 5 hours worked

For my own edification, does that apply to exempt as well?

mlane - not arguing, asking. I know that is the case for non-exempt employees. Is it also the case for exempt employees? I know that in some states, the break laws do not apply to exempt employees.

I should know better when cbg and patty are thinking alike. You both are correct, it only applies to non-exempt, but in the spirit, I have always made sure that exempt personnle get the 30 minutes as well. Hey exempt people have to eat too.

I agree completely. But the question is, how much time is our poster required by law to be given, not what do the responders here think is appropriate., The answer appears to be, none.

Poster, since you are exempt, the employer does not have to give you any breaks at all under state law (Federal law does not require any breaks for any employees). If you take an hour lunch (which the employer is NOT required to pay for) and they want you to work an extra hour to make up for that time, that is completely legal. Since you are not working during your lunch break, you are still only working an 8 hour day.
