All 50 states are required to follow FMLA eligibility requirements. In order to qualify for Federal FMLA, you have to have worked for the employer for 12 months or more, AND you have to have worked a minimum of 1,250 hours, AND your employer has to have a minimum of 50 employees within 75 miles of your location. NJ has a state version of FMLA. which only requires 1,000 hours. However, the only difference to the eligiblity requirements is the lower hours requirement and the 75 mile requirement. It still takes 12 months AND 1,000 hours AND for the employer to have 50 employees. http://www.state.nj.us/lps/dcr/law.html Nothing in the law requires that they allow you to double-dip pay. There is nothing wrong with their limiting your use of PTO or other forms of pay if you are receiving state benefits. You are mistaken about the eligibility requirements - your employer is correct. Nor is your employer violating any laws by not allowing you to double dip. Caution is fine; caution is encouraged. By deleting your post you have, however, ensured that mine will be be the only answer you receive. |
