On 11/25/2007 I injured myself off the job, and my doctor placed me on light duty. I work for the NC state prison system and I was told there were no light duty positions. That was fine, I accpeted that until I found out another correctional officer broker her arm and was given light duty working in the office.

I hurt my ankle went through surgery, a walking cast, a boot and then just a brace. I cannot run, that is my only problem. A position became vacacant at the prison for a case manager position, I applied becasue I had recently graduated college with a BS in criminal justice. I was turned down, saying I did not have enough time.

Well, today I began searching the internet and EEOC policies and I saw this thing about reasonable accomodation. Then I contacted the EEO representative that is over the Department of Corrections and was told I need to fill out a Form DC-730, which is for reasonable accomodation.

My problem is this, every month I have gone to the prison with my light duty doctor notes and I have never been notified of this DC-730 form. I was always told there was nothing I could do, they understand how bored I am, and while it stinks, just get better so I can come back to work.

We have 2 positions that require little to no inmate contact which I could have worked and I would not need to run. I have been without a pay check for 3 months, because I had not been with the state for a year there was no short term disability. I get a call from the HR lady two weeks ago, the state is demanding payment of 1093 for insurance for January and Februay...and it is due immediately, even though I was never sent anything at all, never notified of anything..nothing!

Should the HR person or the assistant superintendent of the prison have mentioned the DC-730 form to me, so I could have tried to work? What liability doe sthe state have?

What can I do?

Is your injury expected to completely heal, given time? Or is your disability permanent?

It will heal over time, I have another doctor's appointment 2/29. My physical therapist says I am about 90%, but my doctor has to fill out an essential job function form.

One of the things on the form is that I need to be able to run, on 2/29 I do not think I will be able to run. Eventually, I will good.

Also, My year anniversary is 03/06/08, if I am out longer will short term disability kick in then? I don't think so, but you never know.

Temporary conditions do not need to be accommodated. It is nice if they are but it isn't required.

Yes you can be expected to pay what is owed for the insurance.

Whether the STD policy will cover depends on the terms of the policy. I'd very much doubt it as this would likely be seen asa pre-existing condition, but I haven't read your policy.
