I have been working for a small programming company for the last 7 years, 5 of those on salary. Over the past 6 months, 2 paychecks have bounced for insufficient funds and being the nice guy I am, I allowed my employer a couple of days to issue me another check.
This has now happened a third time and I have become insulted and fed up with this lack of funds in the particular payroll account my boss says "had an issue", which I believe is just his lazy tranferal of money. I tried cashing my Feb 15th paycheck on the 15th, and a week later find it was bounced. It is Feb 27th and I have not received a replacement check. My paychecks are for aprox $2,200 a pay period.
Luckily none of my own personal checks or debit card transactions were overdrawn.
What are my rights? I tried to find the labor law in NJ or federal guidelines but could not really determine what re-embursement I am due by my company for this action. I read somewhere that I could be paid a day's wages for every day I am not issued a replacement paycheck, but I didn't find that in any law.
Any assistance on this would be greatly appreciated... I don't want to get fired or leave this company, but my boss is a rather high-strung and tempered individual and simply asking about my bounced paycheck seems to enrage him. Having something Legal to back up my position would be very helpful the next time I speak to him about it.
