View Full Version : Position elimination = layoff? Colorado

I work in colorado as an in-home technician for a large retail chain. I have been there for 4 years and have been happy with my job. here's my story.
I was pulled into my managers office along with two other managers last friday. They informed me that we may be losing our In-home vehicle to a different store due to lack of in-home service sales at my location. They then informed me that because we would not have the vehicle that my position would no longer exist at my location. They told me that I will probably be given two options.
1. to take a demotion and a paycut and work in a different department.
2. I could quit.
Now to me it seems that if my position no longer exists it would be considerd a layoff and I would be able to collect unemployment. I mentioned that to them and they said that was incorrect.
Now it seems they may be attempting to fire me because I was put on a conferance call with HR and my store director. Durring this conference call I was informed that a manager that had gone on a ride along with me on saturday said that I said some things about not caring about customers or the company. This is not true however I did vent and joke with him about possibly not having a job. I also may have used some profanity as did he but it was in the privacy of the vehicle while driving.
At this point what should I do? Am I right about this being a layoff? if they fire me for this supposed conversation would I be eligable for UI? Or at this point am I just better off quitting so they dont screw me?

It's water under the bridge now,you would have been eligible if the pay cut was substantial. File a claim,if it is denied appeal it.

Thanks for the quick reply. But could you possibly clarify your answer? Should I wait to be terminated or laid off? If I am not terminated but demoted do you mean that I should file a claim for UI based on the pay cut while I am still employed? At this point there have not been any final decisions to the best of my knowledge. I expect the pay cut to be 25% or more of my current wage, is that a severe pay cut?

Call the Unemployment office to find out how much of a pay reduction is required to file. Every state is different.If you are laid off you are definitely eligible.

I also went to the court house and picked up the necessary papers to file for a small claims lawsuit.. But i am not to sure on how to proceed.. The paper itself is pretty easily filled out but then what.. there are 4 copies and all are labeled for different purposes.. do i turn them all in to the court or do i tear out the one for the defendant and serve it to him?

please help.. any suggestions will be very helpfull
