View Full Version : New Job In MA-No maternity leave Massachusetts

I found out I was a month pregnant two weeks after I started my new job 3 months ago. I work in a very small office with 8 employees myself and one other being female. There is no short term disability offered or anything set in place for maternity. I know I don't apply for FMLA but is there any benefits by law that I am entitled to. I am starting to show and need to tell them soon as it is becoming obvious. I want to be prepared when I sit down with them. Is there anything I have in my favor?

Yes, there is.

MA state law requires that if the employer has six or more employees, an employee who has completed their probationary period with the employer (or, in the absence of a company probationary period, three months of employment) is entitled to up to 8 weeks of unpaid maternity leave.
