I was responsible for posting payroll records and my boss insisted that I alter time sheets to reflect breaks when I had no knowledge of breaks. His policy is to take breaks out of time sheets for pretty much every one. Is this legal?

I'm not a senior member but I can tell you that my company got in big trouble for doing this. If they didn't receive a break and you state that the employee received one in the payroll records you're falsifying records. Check your state law on breaks and when you are required to give them. I'm in New Jersey so it's probably different from my state laws. The dept of labor doesn't care if it's policy. No policy is above the law. In my case we falsified the records b/c we were told to and got fined. I know sometimes it depends on how you classify the employee too. In any case you can not get in trouble. The company will get in trouble if it's reported.

By the way you should start a new thread instead of posting to a thread on a different matter. Ask a senior member to move it or delete it so you can start a new thread.

There is no state where an employer can deduct a break that was not actually taken. However, an employer can require an employee to take breaks even if the employee doesn't want to. Do you know for certain that the breaks were not taken?
