View Full Version : Resigning after FMLA in NY New York New York

I have been working for the same company for almost 15 years. I am at the tail end of my maternity leave and used my FMLA as well. I have also been collecting NYS disability insurance since 12/1. My last day of work was 11/17, and I actually got another 2 weeks off due to a last minute C Section. I have paid my portion of my insurance premiums thru Sat, Feb 23rd. My daughters next drs visit is Fri, Feb 22nd and my return date to work is Mon, Feb 25th. My employer will need to know what my schedule is by Mon, Feb 18th as I work in a retail establishment and this would be the time that I would tell them I am not returning.


I have two questions. One, will I have to pay back their part of the insurance premiums? And two, will my insurance continue thru to the 23rd as I paid for it and need it for my daughters visit to the drs?

The law allows employers to collect reimbursement for insurance premiums paid for employees on FMLA leave. Whether your employer will choose to do so is not something that we can predict. All we can say is that the law allows them to do so. Many employers do not.

The date on which your insurance will terminate depends on the terms of your insurance policy. Many pay through the end of the month, but you need to read the terms of your plan documents to determine whether yours will or not.
