View Full Version : Disability vs Accrued Leave While Pregnant Florida

I am a full time employee and am planning on using accumulated annual and sick leave to maintain income during maternity leave. However, now I have a concern that I might be put on bedrest due to PIH. I still have 2 months to go in my pregnancy and I don't have enough accrued time to pay for 2 additional months of leave.

Am I eligible to file for disabilty? If I have to file for disability, will I first have to use my accrued leave time before it kicks in? Won't this leave me with no money following the birth of the baby, meaning then I will have to come back to work earlier? If filing for short term disability due to pregnancy complications, how long does this typically last? Are there laws that govern this or is this purely based on company policy?

I am an employee who is entitled to FMLA and there are no concerns about me losing my job if I take the entitled time off. The concern is about ongoing income following baby's birth.

Florida is not one of the few states which mandates disability insurance for employees. Unless you already have purchased a disability policy on your own or through a plan sponsored as a benefit by your employer, you're probably out of luck. If you DO have one of the two, what would be covered would be defined by the plan itself.

Please understand that, if you end up having to go on bedrest for 2 months, that time counts toward the 12 weeks to which you are entitled. The bedrest is not going to extend the amount of time you get under FMLA.
