View Full Version : NJ 3 month notice. is it legal? Nebraska New Jersey

I'm employed by a company which HQ is in NJ (only office in the US) and am working in CA.

my contract states the following:

"Employment At-Will: Prior to the conclusion of the assignment duration,employment may be terminated by you or by the Company on an at-will basis byproviding three(3) months notice of such termination."

on the next parargraph is states:
"Notwithstanding anything to the contrary contained in this Agreement you andthe Company each acknowledge that teh employment relationship is on an"at-will" basis, which means that either teh Company or you may terminatethe employment relationship at any time for any reason whatsoever, with orwithout cause or notice."

my understanding is that paragraph 2 contradicts paragraph one by statingthat this is an "at-will" basis... meaning that i can end this employmentrelationship at any time.

i gave my employer 2 months notice instead of 3 (2 colleagues who had the same contract i have and left didn't respect the 3 month notice).

Can i give less then 3 months notice in this case? please help

Yes.

That clause probably won't hold up in court unless there is a binding stipulation that the company will pay you for the 3 months... even if they decide to accept your termination immediately.

But even then, I wouldn't sweat it.

It sounds like they would prefer a 3 month notice,but since they claim employment is "at-will" there is nothing binding. So you can quit whenever you want without any notice.
