Hi,

I'm a manager at a non-profit in North Carolina. All of the workers at the office are contract employees (myself included) and one was recently fired under unpleasant terms.

This employee worked for the non profit for two years full time as a contract employee. He was terminated, with no notice, just after Christmas. My boss has held his check (the employee's December wages) and shows no sign of giving the check to the employee. My boss says that he will give the check to the guy once the former employee finishes a project. The requirements for this project change every time the former employee has come into the office in January to tie things up (5 times so far at 4-7 hours a time) and I despair of him ever getting paid.

Is this legal? What rights does he have? I don't think he qualifies as an independent contractor since he works in an office with 16 workers (all classified as independent contractors), 5 of whom are full time. Can he contact the labor board, or does he need to take our boss to small claims court?
I feel this is immoral, and I'm fairly sure illegal, and would like to know how to report these abuses to the authorities. Is the labor board the correct body to contact?
