I work for a small (21 employees) AZ company. What should we legally be offering our employees for maternity leave? Unpaid or paid leave and how long? Job protection? Can you offer a different position? Different compensation? Thank you!!
Since you have only 21 employees, FMLA does not apply. AZ has no laws regulating maternity leave.
It is entirely up to you how much leave to grant and whether or not it is paid or unpaid. Under the law, there is no guaranteed job protection although you are free to provide it.
The only qualifier is that you cannot treat pregnancy differently than you do other medical conditions.
