View Full Version : Want to take job in NY 3 months Pregnant New York

Hi!
I got a job offer in NY, that I would like to take. But I am concerned that I am 3 months pregnant and will need time off after only working 4 months or so. FMLeave will not cover me because I will only be working 4 months before I give birth. What should I do? The company offering me the job does not know about the pregnancy.
Is there disability that will cover me while I am on leave?
Can the place fire me because I need time off?

NY is one of the very few states that mandates disability.

Since you will not be eligible for FMLA, the employer is not obligated to hold your job for you IF they would not hold the job of a similarly situated employee who was also not eligible for FMLA and who had a non-maternity medical condition.

They can fire you if they would fire someone else who needs a similar amount of time off for a medical reason after working there 4 months. No one here has a crystal ball so we dont' know anymore than you do what the company's policy will be. You can always ask what is offered.

What does that exactly mean?

If the company normally would hold a job for someone for 6 weeks with any other disability, they would have to do that for me?

Any advice on how you would proceed if you were in this situation?

Also is there a way to find out the company's disability policy?

Also is there a website that clearly states NY's disability laws?

1.) In 45 out of 50 states, it is entirely up to the employer whether to offer disabilty benefits or not. NY is one of the remaining five, where the employer is required to offer disability benefits, either a private policy or through the state.

2.) Yes, that's right. Assuming that the other employee was similarly situated.

3.) Yes. Ask them about their policy. You may be getting upset over nothing.

New York employers are required to provide disability insurance for their employees, either through an insurance company or by contributing to the state fund. The employer may (although they are not required to) deduct up to $.60 per week to offset the cost of providing the insurance.
