View Full Version : tuition payment + hostile work environment West Virginia

I complained several times to both my contractor and subcontractor about the hostile work environment that I was in. One was compassionate and the other was not. One really had no concern at all and had more of a "boys will be boys" attitude. after 8 months I have decided to call it quits. I am done playing this game. I was told I had to sign a statement for tuition reimbersment if I was to attend a training that was required for my position. The training was 2800.00, that was back in may of last year. I am in WV and the contract is from MD. I want to know if I have to pay the entire amount back. Due to the fact that it was deamed required for my new position, I was transfered from one jobset to another within the contract, and was no longer on my jobset, I had to attend training. I had no choice.


This Agreement made on the _____ day of _________, 20 ___, between ____________________ (employee) and (deleted by moderator) is as follows:
(deleted) agrees to reimburse the tuition/training costs related with the successful completion of
_________________________________ class, in the amount of $__________________.
It is further agreed and understood that if the employment relationship between the employee and (deleted)terminates for any reason, within twelve (12) months of cost reimbursement, the amount reimbursed to the employee will become immediately due and payable to (deleted), at the time of notice of employment termination. In such event, employee expressly authorizes (deleted) to deduct this amount from his/her pay. Any amounts outstanding after 30 days of the notice of employment termination will bear interest at the rate of 1 1/2 percent per month. Employee hereby expressly waives any statutory provisions under the law.
If the employee remains a full time employee of (deleted) for a period of twelve (12) months following the date of reimbursement, he/she shall no longer be obligated to repay the above amount.
No language in this agreement can be construed to create an employment relationship, other than that of will.

This agreement confirms that these conditions were discussed with the employee by his/her supervisor (_____________________________), and that the employee fully understands and agrees to them.
This agreement is governed by the laws of the State of Maryland in Montgomery County.

I have deleted all references to your employer's name. That is for your safety.

A hostile work environment has a very specific meaning under the law. I would say that about 97% of people who post here believing that they are in an HWE, aren't. Before we go much further, it would be helpful if we could determine if you were actually in an HWE or not. Can you provide some details?

If you are actually working in MD, the agreement would be enforceable and you would owe the money back. Since it is a separate agreement they may also deduct the cost of the training from your last paycheck.
