Hello,
My father was terminated from his job on September 1, 2007. The Company which terminated filed a claim with the state claiming that he was discharged for misconduct for threats upon a coworker. Father worked for company for 13 years, never had any written warnings, valued employee. Was wrongly accused by a Spanish speaking coworker of issuing death threats even though words were lost in translation.
After going through the hearing process with the examiner, the examiner ruled against my father and revoked his unemployment wages for a six week period. Lies were brought up by the CFO of the Company to the examiner and these lies were used as a basis for the ruling in the case.
I plan to file an appeal to the ruling. What legal advice would you suggest to take going forward? Would it be cost-effective to engage a lawyer? Also, what is the likelihood that the ruling is overturned? The Company stated several lies in an attempt to bolster the case and these facts ultimately resulted in the examiner ruling in their favor. These lies also included providing "witnesses" which were not even present at the time of the incident.
Any insight would be appreciated, I would be very interested to know our chances of having the ruling overturned in the appeals process.
