If I terminate employment with the company that consistently is issuing "bad" checks am I eligible for unemployment benefits?

Maybe. This is not a "set in stone" answer. Unfortunately, every state's reasons for disqualifying a claimant from benefits is different. You could call the DESC and ask them, but even so, an answer from someone on the phone is not going to hold any legal weight.

Generally speaking, though, the state would rather you have some income, even if it is "late" that none at all.

If I post numbers to the Ms DOL and wage and hour board or give them out to the other emplooyees can this company legally dismiss me?

Can they legally? Again, the answer is probably. In many states, "whistleblower" laws exist, or at least a public policy violation IF you report a violation of law to the applicable regulatory authority. However, giving out the phone number to the DESC would not be, in my opinion, a protected activity.

I'm sorry I don't have a better answer for you, but your state is pretty weak when it comes to wage payment laws.

I don't suggest you post the numbers. You can distribute the phone numbers to other employees but I strongly suggest you do so in a non-work area and on non-work time and be discreet about it. Frankly, outside of work entirely would be best.

If you're dismissed for doing so, chances are that's unlawful and there would be consequences for your employer but in the meantime, you're out of work which does you no good. You can also report the bad paychecks to the police as issuing worthless checks is a crime.

If the OP engaged other employees in a conversation about the late checks, and then gave the number, wouldn't the be acting in concert, and thus be legally protected from being discharged?

Granted, I'm not saying the OP wouldn't be fired anyway, but wouldn't that give the OP recourse if let go?

I have chosen to take a position with a temp agency for 2 weeks due to lack of funds(which is due to lack of valid paychecks...). This will mean leaving the company that seems to have so many financial problems.

What office do I contact to see if I can obtain unemployment compensation after this temp work ends? Or should I just file a claim? I could continue with the problem company but really do not like the idea of never knowing if and when I will be paid.
