Does an employer have a right to make you work manditory overtime in NH or is this against the law?

If you work a regular 40 hour week and your employer requires you to work 5 hours of manditory overtime each week and you are out sick during your regular 40 hour week 3, 4, 5 or even a full 8 hour day does your employer have the right to make you work the 5 hours of manditory overtime anyhow even if it is not for overtime pay????

I'm assuming you're a non-exempt employee.

Yes, they have the right to make you work mandatory OT.

You get paid for OT when you *actually* work over 40 hrs. a week - however, your employer is doing nothing illegal.

Mandatory overtime is legal in every state in the Union. Only two states have general limits on how much overtime may be required. Move a few miles to Maine and you can only be forced to work 80 hours of overtime in any two consecutive work weeks.

You are not entitled to overtime pay if you have not actually worked more than 40 hours. If you are non-exempt and you work more than 40 hours a week, mandatory or voluntary, you get paid overtime for those hours.
